Child support in Luxembourg:
no set formula… but it’s not left to chance either.
Unlike some neighboring countries, we do not have an official schedule for determining child support payments. There is no chart, no automatic formula, and no ready-made mathematical equation.
This may come as a surprise, and some people assume that the amounts are set “on a whim.” In reality, that’s not the case at all.
What criteria?
Child support is based on a detailed analysis of several factors that allow the amount to be tailored to each family’s specific circumstances.
The first factor concerns the child’s basic needs. Child support is intended to cover everyday expenses: housing, food, clothing, school expenses, activities, healthcare, and leisure. However, these needs are not the same for all children. They naturally change depending on the child’s age, living situation, and the family routines that existed before the separation.
Another factor is also taken into account: child support. The specific purpose of child support is to contribute to the child’s upkeep, and it is therefore generally factored into the assessment of needs.
The second important factor is the child’s living arrangement. When the child lives primarily with one parent, that parent covers most of the daily expenses. The other parent then provides financial support through child support.
When a child lives in an alternating custody arrangement, the situation may be different since expenses are shared between both parents. However, this does not mean that child support cannot be ordered. If the parents’ incomes differ significantly, a financial contribution may still be necessary to maintain a certain balance in the child’s living conditions.
The third key factor is the parents’ financial situation. The judge reviews each parent’s income, whether from employment or from any investment income. Fixed expenses may also be taken into account to assess each parent’s actual ability to contribute.
The principle is simple
Each parent must contribute to the support and upbringing of their child in proportion to their means.
Thus, even in the absence of an official schedule, the determination of child support is based on a clear set of criteria: the child’s needs, living arrangements, and the parents’ financial resources.
Our courts therefore favor an individualized approach.
